Terms of Service

These Terms govern your access to and use of the talp website and platform. By using talp you agree to these Terms.

1. The service

talp, Inc. (“talp”, “we”, “us”) provides a behavior analysis engine that simulates human intent and behaviour, including Ad Intelligence, Product Intelligence and Strategy Intelligence. Outputs are predictive simulations intended to inform your decisions, not guarantees of real-world outcomes.

2. Accounts

You are responsible for the accuracy of the information you provide, for activity under your account, and for keeping credentials secure. You must be authorized to act on behalf of any organization you register.

3. Customer content

You retain ownership of the materials you submit. You grant talp a limited licence to host and process that content solely to provide the service. You represent that you have the rights to submit it and that it does not infringe third-party rights or applicable law.

4. Acceptable use

• Do not use talp to break the law, infringe rights, or generate unlawful, deceptive or harmful material.
• Do not attempt to reverse engineer, disrupt, or gain unauthorized access to the platform.
• Do not misrepresent simulated outputs as statements by, or data about, identifiable real people.

5. Intellectual property

talp and its underlying technology, models and brand are owned by talp, Inc. (“talp”, “we”, “us”) and its licensors. Except for the rights expressly granted to you, no rights are transferred.

6. Fees

Paid features are governed by the order or agreement between you and talp. Unless stated otherwise, fees are non-refundable.

7. Disclaimers

The service is provided “as is”. To the fullest extent permitted by law, talp disclaims all warranties, express or implied. Simulations are probabilistic and you remain responsible for decisions you make using them.

8. Limitation of liability

To the fullest extent permitted by law, talp will not be liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our aggregate liability is limited to the amounts you paid to talp in the twelve months before the claim.

9. Termination

You may stop using talp at any time. We may suspend or terminate access for breach of these Terms or to protect the service. Provisions that by their nature should survive will survive termination.

10. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Courts located in Delaware will have exclusive jurisdiction, subject to any mandatory consumer protections.
